Physicians’ Assistants Can’t Perform EMGs

State law requires EMGs to be performed by a physician, not a physician’s assistant, the Supreme Court ruled Wednesday in a case of first impression. The plain language of the Physician Assistance Licensing Act, statute is that electromyography a diagnostic test of the health of the muscles and the nerves that control them may not be administered by anyone who is not licensed to practice medicine and surgery. Physician assistants do not receive a license. The unanimous Court declined to say whether its ruling in Selective Insurance Co. of America v. Rothman, M.D., A-60-10, should be limited to prospective application.
