Viking Range Recalls Dishwashers Due to Fire Hazard

The Consumer Product Safety Commission has announced a recall of about 2,000 Viking dishwashers due to a faulty electrical component that can overheat and cause a fire. The recall covers Viking 24″ Professional, Design and Custom Panel dishwashers sold in black, white and other custom colors. Rider Hurt in Poconos ATV Crash Awarded $15 Million Judgment

A man allegedly left permanently disabled in an all-terrain-vehicle accident won a $15 million default judgment in his Monmouth County suit, Wojcik v. Mastorio.

On Aug. 10, 2008, Michael Wojcik, then 24, was riding on the back of an ATV driven by Joseph Mastorio, also 24, in the Pocono Mountains. As Mastorio rounded a curve on the road too quickly, the vehicle struck a pothole, causing both men to be ejected.

Wojcik hit a tree head-first, the impact shattering his bicycle helmet. He suffered brain and spine injuries and facial and rib fractures and was comatose for several weeks. He underwent five procedures and suffered two strokes, according to his lawyers, Brian Yesalonis and James Martin of Martin Kane Kuper in East Brunswick.

He is unable to speak, lost vision in his right eye and use of his left hand, walks with a limp, has significant memory and cognitive problems and must be fed through a tube because he has trouble swallowing, his lawyers say.

Mastorio, of Cliffwood Beach, admitted to police to consuming alcohol before the crash and had a.11 percent blood-alcohol content, above the legal limit. He was served with the suit but never appeared, Yesalonis says. Judge Honora O’Brien Kilgallen granted the default judgment on March 12.

Yesalonis says he has been unable to ascertain whether Mastorio had liability coverage but will file an information subpoena on him.

Husqvarna Recalls Grass and Hedge Trimmers Due to Fire Hazard

The  Consumer Product Safety Commission has announced a recall of about 26,000  hedge and grass trimmers due to an increased fire risk. Manufactured by  Husqvarna Machinery Manufacturing Co., the agency said the fuel lines that  run from the tank can leak, posing a fire hazard. Doctor Panels Urge Fewer Routine Tests

In a move likely to alter treatment standards in hospitals and doctors’ offices nationwide, a group of nine medical specialty boards plans to recommend on Wednesday that doctors perform 45 common tests and procedures less often, and to urge patients to question these services if they are offered. Eight other specialty boards are preparing to follow suit with additional lists of procedures their members should perform far less often.

Lacrosse Helmets Recalled by Easton Sports

The  Consumer Product Safety Commission has issued a recall of about 12,000  lacrosse helmets due to a defect in the chin bar that can lead to facial  injuries. Imported by Easton Sports, the agency said the helmet’s chin bar  can break off upon impact with a ball or lacrosse stick, posing a risk of  facial or jaw injury. 7,000 Ceiling Fans Recalled

Multiple Suicides at New York Jail Prompt Suit

(Reuters) – A civil liberties group filed a lawsuit on Wednesday accusing a New York county of poor oversight of a local jail where five inmates have committed suicide since 2010.

The New York Civil Liberties Union filed its suit in state Supreme Court against Nassau County, on Long Island, in light of the recent death of Iraq war veteran Bartholomew Ryan.

Ryan, 32, hung himself in February shortly after being jailed on a drunk driving charge, according to the lawsuit.

Suit: Denial of Request to Rebuild Mosque is Illegal

The Los Angeles office of the Council on American-Islamic Relations and a civil rights law firm have filed a joint complaint against the city of Lomita for denying the Islamic Center of South Bay’s application to rebuild and renovate its mosque.‬

‪The federal complaint, filed Wednesday at the U.S. District Court in downtown Los Angeles, contends that the city is discriminating against the mosque and that there is no evidence to back up neighbors’ concerns of increased traffic.

Oil Refinery Contaminated Nearby Town, Suit Says

EDWARDSVILLE • The village of Roxana has sued current  and former owners and operators of the Wood River Refinery over alleged damages  to village-owned property resulting from releases of cancer-causing  chemicals.

According to the lawsuit, benzene contamination on some village-owned land  measures as high as 2.6 million percent of allowable limits in Illinois. The  village alleges that spills, leaks and other discharges have contaminated  streets, alleys, ground water and the village’s public works yard.

Suit Against New York Law School Dismissed

A  New York Supreme Court judge has tossed out a lawsuit filed against the New York Law School by former students over alleged inflated graduate and job-rate statistics. The judge dismissed the lawsuit, saying “the school’s marketing materials weren’t misleading and that the students had ‘ample  information’ from other sources about job prospects.” The judge also pointed to the recession that hit the county in 2008, having a particular effect on the legal market, which  was beyond the control of the law schools.  Chris Dolmetsch, Bloomberg  03/21/2012
